Terms and Conditions of Hire

Definitions:

‘Equipment’ refers to any scooter, powerchair or manual wheelchair, ramps or accessories, keys, chargers and electrical equipment on hire from Wight Phoenix Mobility Scooter Hire.

‘User’ is the person specified on the Hire Form as being the intended User of the Equipment and, where this is not the Customer, will be treated for the purposes of these Terms and Conditions as using the Equipment with the Customer’s full approval.

‘Hire Period’ is the period of time specified on the Hire Form from the collection of the Equipment by the Customer or the User to its return to Wight Phoenix Mobility Scooter Hire or as amended by prior agreement with Wight Phoenix Mobility Scooter Hire.

‘Day’ is either a 24 hour period in the case of Private Hire, or the event’s opening hours in the case of Event Hire.

The Customer declares that:

a)The Customer is at least 18 years of age;

b)The Customer reasonably believes that the User is capable of safely operating the Equipment. In particular, but without limitation, the Customer is satisfied that Wight Phoenix Mobility Scooter Hire has provided the User with adequate information and training (where necessary) and confirms that the User has not been medically assessed as being unfit to operate the Equipment or any equipment similar to it;

c)The Customer will take good care of the Equipment at all times during the Hire Period, and will ensure that it is used only in accordance with the instructions, either written or verbal, provided by Wight Phoenix Mobility Scooter Hire and, where the User is under 18 years of age, that the User is accompanied by an adult at all times when using the Equipment;

d)Only the User will use the equipment, except to the extent that Wight Phoenix Mobility Scooter Hire has given its written consent for the Customer, or the Customer’s authorised representative, to collect/deliver the appliance to/from the User). In particular, but without limitation, the Customer will ensure that no passengers are allowed to ride on any Equipment or to stand on the back bumper or platform;

e)Unless otherwise stated on the Hire Form, the User does not weigh more than 15 stone for the GoGo Elite Lx (and similar) range, or 20 stone for the GoGo Elite Traveller Plus (and similar) range. Wight Phoenix Mobility Scooter Hire reserves the right to cancel any booking and/or repossess the Equipment, if it becomes apparent that any of the above information is untrue.

2)If the Equipment has not been collected by one hour after the commencement of the Hire Period, and Wight Phoenix Mobility Scooter Hire has not been contacted regarding the delay, Wight Phoenix Mobility Scooter Hire will be entitled to regard the booking as cancelled.

3)In the event of cancellation of a booking by the Customer with less than 48 hours’ notice (for whatever reason, including cancellation of any event at which the Customer was planning to use the Equipment), the hire fee for the Equipment will remain payable in full. With less than two weeks notice of cancellation a refund of 50% will be given.
In all other instances, Wight Phoenix Mobility Scooter Hire will refund any deposit received.

4)The Equipment must be returned to Wight Phoenix Mobility Scooter Hire by the specified time at the end of the Hire Period in the same condition as it was supplied to the Customer. If delayed, please notify Wight Phoenix Mobility Scooter Hire immediately by telephone. If the Equipment is returned later than the date and time shown on the Hire Form (or if any actions by the Customer prevent Wight Phoenix Mobility Scooter Hire from collecting the Equipment at the agreed time) the Customer will pay Wight Phoenix Mobility Scooter Hire for the extended Hire Period at the appropriate daily rate.

5)The charges for hiring the Equipment (and any delivery and collection charges) are set out on, and payable in accordance with, the Hire Form and/or the Booking Details Form. The Equipment will not be made available to the User until all payments due by the commencement of the Hire Period have been made.

6)The Customer accepts full liability for any loss of or damage to the Equipment, and any injury to the Customer, the User or any third party caused (in each case) during the Hire Period, and which are caused other than as a result of Wight Phoenix Mobility Scooter Hire’s negligence. The Customer is therefore strongly advised to obtain appropriate insurance to cover this potential liability. For the avoidance of doubt, however, nothing in these Terms and Conditions is intended to exclude Wight Phoenix Mobility Scooter Hire’s liability for any death or personal injury caused as a result of its own negligence.

7)The Customer or User must immediately report to Wight Phoenix Mobility Scooter Hire any loss of or damage to the Equipment, and any accident causing personal injury to anyone or any damage to property.
